## End-User License Agreement (EULA) for KYUBIT JavaScript Charts Library Component 

**IMPORTANT: READ CAREFULLY BEFORE DOWNLOADING OR USING THIS SOFTWARE.**

This End-User License Agreement ("EULA") is a legal agreement between you ("Licensee") and KYUBIT Solutions, LLC ("Licensor") for the KYUBIT JavaScript Charts Library component software ("Software"). By downloading or using the Software, you agree to be bound by the terms and conditions of this EULA. If you do not agree to all the terms of this EULA, you may not download or use the Software.

**1. Grant of License**

Licensor grants you a non-exclusive, non-transferable, limited license to use the Software for the following purposes:

* **Evaluation:** You may evaluate the Software for non-commercial purposes only without the production license.
* **Development:** You may use the Software to develop and test your web applications without the production license.

**Production Use Requires Production License**

For production use of the Software in any web application or website, you must purchase a production license from Licensor.

**2. License Restrictions**

You may not:

* Distribute the Software, in whole or in part, to any third party without a commercial OEM license from the Licensor.
* Modify, reverse engineer, decompile, or disassemble the Software.
* Remove or alter any copyright notices or trademarks from the Software.
* Sublicense the Software to any third party.
* Use the Software for any purpose other than those expressly permitted by this EULA.

**3. Copyright**

The Software is protected by copyright laws and international intellectual property treaties. Licensor owns all right, title, and interest in the Software.

**4. Disclaimer of Warranty**

THE SOFTWARE IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL FUNCTION WITHOUT ERRORS OR INTERRUPTIONS.

**5. Limitation of Liability**

IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA) ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

**6. Term and Termination**

This EULA will be effective upon your download or use of the Software and will remain in effect until terminated. You may terminate this EULA by destroying all copies of the Software in your possession. This EULA will automatically terminate if you violate any of its terms. Upon termination, you must cease all use of the Software and destroy all copies of the Software in your possession.


**7. Entire Agreement**

This EULA constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

**8. Severability**

If any provision of this EULA is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
